SkinMama Terms of Service
These Terms of Service (“Terms”) are a legally binding agreement between you (“you,” “User”) and SkinMama (“we,” “us,” “our”) governing your access to and use of the SkinMama mobile application and related services (the “Services”). By downloading, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1) Acceptance of Terms#
By creating an account, downloading the app, or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
2) Eligibility (13+)#
You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you represent that you have permission from a parent or legal guardian to use the Services and agree to these Terms.
3) Changes to These Terms#
We may update these Terms at any time. If we make material changes, we may notify you by updating the “Last Updated” date and/or through in-app notice. Your continued use of the Services after changes become effective means you accept the updated Terms. If you do not agree, you must stop using the Services.
4) Privacy#
Your use of the Services is also governed by our Privacy Policy. By using the Services, you acknowledge you have read and understood how we process your information.
5) Account Registration and Security#
To use certain features, you may need an account. You agree to:
- Provide accurate, current, and complete information.
- Keep your login credentials secure and not share them.
- Notify us promptly if you suspect unauthorized access to your account.
You are responsible for all activity that occurs under your account.
6) Services Overview#
SkinMama may include:
- Skin analysis based on required questionnaire responses and required facial/skin photos.
- Scan history and progress tracking.
- Personalized skincare routines and recommendations.
- A public community forum (user-generated content), including community posts that may include app-generated attachments (analysis summaries, product recommendations, and routine details).
- An AI chatbot for informational guidance and app assistance.
We may change, suspend, or discontinue any part of the Services at any time.
7) User Content and Public Forum (UGC)#
7.1 Your Content
You may submit content such as text, images, comments, and reactions (“User Content”). You retain ownership of your User Content.
7.2 Community Posts Include App-Generated Information
When you create a community post, the Services may require you to include and publicly display certain information generated inside the app, including:
- Skin analysis results or summaries
- Product recommendations
- Routine details
These items may be generated from your scans, questionnaire responses, and use of the Services. By publishing a post, you acknowledge and agree that any included app-generated information becomes public within the forum.
7.3 License to Operate the Services
By posting or submitting User Content (including any app-generated analysis, product recommendations, and routine details included in your post), you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting and display), publish, display, and distribute your User Content solely to operate, maintain, improve, moderate, and promote the Services and the forum, and to enforce these Terms.
7.4 Public Visibility
The forum is public within the Services. Your User Content (including any app-generated analysis, product recommendations, and routine details included in your post) may be visible to other users and may be copied, screenshot, reshared, or referenced by others outside the Services. We cannot control what others do with content once it is public. Do not post anything you consider private or confidential.
7.5 Prohibited Content and Conduct
You agree not to post, upload, transmit, or otherwise make available any User Content or engage in conduct that:
- Is illegal, fraudulent, or promotes illegal activity.
- Is threatening, harassing, hateful, defamatory, or abusive.
- Includes sexual content involving minors, or exploits or endangers minors in any way.
- Violates another person’s privacy, publicity, or intellectual property rights.
- Is spam, misleading, impersonation, or deceptive behavior.
- Attempts to disrupt, overload, or interfere with the Services or security features.
- Contains malware or malicious code.
7.6 Reporting, Moderation, and Enforcement
We provide tools to report posts and comments. We may monitor, review, remove, restrict, or block content (including automatically based on violations and report signals) and may suspend or terminate accounts or restrict access to features (including the forum or posting) for violations, repeated reports, or other safety signals. We are not obligated to monitor all content and we do not guarantee removal of any specific content.
8) Skincare and Medical Disclaimer#
8.1 Informational Purposes Only
The Services provide skincare insights and recommendations for informational and cosmetic/self-care purposes only. They are not intended to diagnose, treat, cure, or prevent any disease and do not replace professional medical advice.
8.2 No Doctor–Patient Relationship
No doctor–patient relationship is created by your use of the Services. Always seek advice from a qualified professional regarding medical conditions or concerns.
9) Face Photos, Permissions, and Processing#
9.1 User Submission and Consent
Scan/analysis features require you to submit facial/skin photos. We only process photos you actively submit through the app. If you do not provide the required photo, you cannot use scan/analysis features.
9.2 AI Processing
We may process images and text using third-party AI services and/or self-hosted AI services to generate analysis results and chatbot responses. Processing is performed solely to provide the Services as requested.
9.3 Scan History and Deletion
The Services store scan history (including images and derived results). Scan history cannot be turned off. You can delete your account in-app to delete your scan history and associated account data as described in our Privacy Policy.
10) Acceptable Use#
You agree not to:
- Reverse engineer, decompile, or attempt to derive source code from the Services except where permitted by law.
- Bypass access controls, probe, scan, or test vulnerabilities.
- Use automated tools to scrape or overload the Services.
- Use the Services in a way that violates applicable law or these Terms.
11) Intellectual Property#
The Services (including software, designs, text, graphics, logos, and other content provided by us) are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from the Services except as allowed by law or with our written permission.
12) Purchases and Subscriptions (If Applicable)#
If the Services offer paid features or subscriptions:
- Pricing and billing terms will be shown at purchase.
- Payments may be processed by Apple/Google or other payment providers.
- Subscriptions may auto-renew unless canceled according to the platform’s rules.
- Refunds are governed by the applicable platform’s policies unless otherwise stated.
13) Termination#
13.1 Termination by You
You may delete your account at any time from in-app settings. Upon deletion, you lose access to the Services.
13.2 Termination by Us
We may suspend or terminate your access to the Services if you violate these Terms, create risk or liability, or if we are legally required to do so. We may also restrict access to specific features (including the forum or posting) without terminating your full account.
13.3 Effect of Termination
Upon termination, your right to access the Services ends. Sections that by their nature should survive termination will survive (including licenses you grant, disclaimers, limitation of liability, and indemnification).
14) Disclaimers#
To the maximum extent permitted by law:
- The Services are provided “as is” and “as available.”
- We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Services will be uninterrupted, timely, secure, error-free, or that defects will be corrected.
- We do not guarantee the accuracy, completeness, or usefulness of any outputs, including AI-generated outputs.
15) Limitation of Liability#
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of the Services.
To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Services will not exceed the amount you paid to us for the Services in the six (6) months before the event giving rise to the claim. If you paid nothing, our total liability will not exceed NPR 1,000. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
16) Indemnification#
You agree to defend, indemnify, and hold harmless SkinMama and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use or misuse of the Services
- Your User Content
- Your violation of these Terms
- Your violation of any law or the rights of another person or entity
17) Third-Party Links and Services#
The Services may include links to third-party websites or services. We do not control or endorse third parties and are not responsible for their availability, content, or practices. Your use of third-party services is at your own risk.
18) Dispute Resolution#
18.1 Governing Law
These Terms are governed by the laws of Nepal, without regard to conflict-of-law principles, unless mandatory law in your jurisdiction requires otherwise.
18.2 Arbitration
Any dispute arising from or relating to these Terms or the Services will be resolved by binding arbitration administered by the Nepal Council of Arbitration (NEPCA) in accordance with its rules. Judgment on the award may be entered in any court of competent jurisdiction.
18.3 Class Action Waiver
You agree to resolve disputes on an individual basis and not as a plaintiff or class member in any class, consolidated, or representative action, to the extent permitted by law.
19) International Users#
Your information may be processed and stored in countries where we or our service providers operate, as described in our Privacy Policy. You agree to comply with local laws applicable to your use of the Services.
20) Severability and Waiver#
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right or provision does not waive that right or provision.
21) Entire Agreement#
These Terms and the Privacy Policy constitute the entire agreement between you and SkinMama regarding your use of the Services and supersede any prior agreements or understandings.
